Wally’s Cafe, Inc., doing business as Wally’s Café Jazz Club (“Wally’s,” “we,” “us,” or “our”), respects your privacy and is committed to responsibly handling personal information.
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you:
- Visit wallyscafe.com or another website operated by Wally’s;
- Contact us about venue rentals, private events, performances, bookings, partnerships, donations, or general inquiries;
- Subscribe to our newsletter or other email communications;
- Make a donation through our website;
- Attend an event or visit Wally’s Café Jazz Club;
- Participate in a Wally’s program;
- Interact with our social-media pages; or
- Otherwise communicate or do business with us.
This Privacy Policy describes our information practices. It does not replace any separate rental agreement, ticket terms, performer agreement, appearance release, program consent form, employment policy, or other agreement that may apply to a particular interaction.
1. Information We Collect
The information we collect depends on how you interact with Wally’s.
A. Information You Provide Directly
Venue rental and private-event inquiries. When you contact us about renting Wally’s or holding a private event, we may collect:
- Your name;
- Telephone number;
- Email address;
- Organization, company, or event name;
- Preferred event date and time;
- Type and purpose of the event;
- Expected attendance;
- Catering, bar, accessibility, production, backline, or technical requirements;
- Budget or payment-related information; and
- Other information you choose to provide.
General inquiries. When you email, telephone, submit a website form, or otherwise contact us, we may collect your contact information, the contents of your communication, and information reasonably necessary to respond to your request.
Newsletter and promotional communications. When you subscribe to receive information about performances, jam sessions, community programs, fundraising campaigns, merchandise, or Wally’s news, we collect your email address and any communication preferences you provide.
Donations. When you make a donation through our website, our donation platform, GiveWP, may collect information including:
- Your name;
- Email address;
- Mailing or billing address;
- Donation amount;
- Donation date;
- Dedication, comment, or message information; and
- Information necessary to issue a receipt and maintain donation records.
Online payments are processed by PayPal or another payment processor identified at checkout. Wally’s does not receive or store your complete payment-card number or card security code. We may receive limited transaction information, such as your name, email address, billing information, donation amount, payment status, transaction date, and transaction confirmation number.
Artist, musician, vendor, and partner information. When you contact Wally’s about a performance, artist booking, sponsorship, partnership, community program, or vendor relationship, we may collect:
- Contact information;
- Artist, band, organization, or business name;
- Biography and professional history;
- Photographs, recordings, and promotional materials;
- Performance availability;
- Technical and hospitality requirements;
- Contract and payment information; and
- Tax or identity information when legally required to make a payment.
Tax documents, banking information, government identification numbers, and other sensitive information should be submitted only through a method specifically authorized by Wally’s and not through a general website contact form.
Youth and community programs. When Wally’s operates or participates in a youth, educational, senior, or community program, we may collect information reasonably necessary to administer that program, including:
- Participant name;
- Parent or guardian information;
- Contact information;
- Scheduling and attendance information;
- Emergency-contact information;
- Accessibility or accommodation information;
- Program registration details;
- Consent forms; and
- Photography, video, or media permissions.
Where required, information concerning a child will be collected from or with the authorization of a parent or legal guardian. A program-specific registration form or consent document may contain additional privacy information.
B. Information Collected at Wally’s Café Jazz Club
Security cameras. Wally’s uses security cameras in entrances, performance areas, bar areas, and other public or common areas for purposes including:
- Protecting the safety of guests, performers, employees, vendors, and visitors;
- Protecting Wally’s property;
- Preventing and investigating theft, vandalism, misconduct, and other security incidents;
- Responding to accidents, disputes, and insurance matters;
- Preserving evidence relating to an incident; and
- Complying with applicable legal obligations.
Wally’s security cameras record video only. They do not record audio. Wally’s does not use facial recognition, biometric identification, automated identity matching, or similar technology in connection with its security cameras. Security cameras are not placed in restrooms or other areas where individuals reasonably expect privacy.
Access to security footage is limited to authorized individuals and service providers with a legitimate safety, security, insurance, operational, or legal need. Security footage is generally retained for a limited period unless it is needed to investigate an incident, respond to an insurance claim, preserve evidence, respond to a legal request, protect the rights or safety of Wally’s or another person, or comply with a legal obligation.
Photography, video, livestreaming, and audio recording of performances. Wally’s is a live music venue and historic cultural institution. Performances, programs, and events may be photographed, filmed, livestreamed, or audio recorded for purposes including:
- Broadcasting or livestreaming performances;
- Promoting Wally’s and its performers;
- Creating website and social-media content;
- Documenting Wally’s history;
- Creating an artistic, cultural, or historical archive;
- Producing documentary or educational materials;
- Supporting fundraising and sponsorship activities; and
- Producing authorized recordings or releases.
Audience members may appear incidentally in photographs, livestreams, or video recordings, particularly in wide shots of the stage, musicians, audience, or venue. When Wally’s plans professional or organized photography, video recording, or livestreaming, we will use reasonable efforts to provide notice through event materials, posted signs, announcements, or another appropriate method.
This Privacy Policy does not replace a performer release, appearance release, parental authorization, location release, union agreement, recording agreement, or other permission where one is legally or contractually required. Guests who have concerns about being photographed or recorded should speak with a Wally’s representative before entering the event or as soon as possible after arriving. Although we will consider reasonable requests, we cannot guarantee that a person can be removed from a completed recording, archived material, photograph, or live broadcast. Other guests may independently take photographs or videos. Wally’s does not control and is not responsible for the independent privacy practices of individual attendees.
C. Information Collected Automatically Online
When you visit our website, our web host, security providers, analytics providers, content-delivery providers, and other technical service providers may automatically collect information such as:
- Internet Protocol address;
- Browser type;
- Device type;
- Operating system;
- Approximate location derived from an IP address;
- Referring and exit pages;
- Pages and links viewed;
- Date and time of access;
- Session duration;
- Website errors and diagnostic information;
- Cookie or device identifiers; and
- Information about how you interact with the website.
We use this information to operate, secure, maintain, troubleshoot, and improve our website.
D. Information Received From Third Parties

Promotional emails will include a method for unsubscribing. You may also request to unsubscribe by emailing [email protected]. After you unsubscribe, we may retain your email address on a suppression list so that we can honor your request and avoid sending additional marketing communications.
Unsubscribing from promotional emails will not prevent us from sending necessary transactional or administrative communications, such as donation receipts, responses to inquiries, rental communications, contract communications, program information you requested, security notices, or other messages relating to an existing transaction or relationship.
We do not use telephone numbers submitted through rental or contact forms to send promotional text messages unless we separately obtain any consent required by applicable law.

Cookies are small files placed on your browser or device. Our website may use cookies and similar technologies.
Essential cookies may support website operation, website security, form submissions, donation processing, session management, and user preferences.
Analytics cookies. If analytics services are enabled, analytics cookies may help us understand website traffic, frequently visited pages, website performance, visitor interactions, and technical problems.
Embedded-content cookies. Pages containing maps, videos, music players, social-media content, or other embedded third-party services may allow the applicable provider to place cookies or collect device and usage information.

5. Payment Processing
Online donations are facilitated through GiveWP and processed by PayPal or another payment provider identified at checkout. Payment processors independently collect and process payment credentials under their own privacy policies and terms.
Wally’s may receive your name, email address, billing address, transaction amount, transaction date, payment status, and a transaction or confirmation number. Wally’s does not receive or store your complete payment-card number or card security code. You should review the applicable payment processor’s privacy policy before completing a transaction.
6. How We Disclose Personal Information
Wally’s does not sell or rent personal information. We may disclose personal information in the following circumstances.
Service providers. We may provide information to businesses that perform services for Wally’s, including providers of website hosting and maintenance; website security; data backup and storage; donation and payment processing; email delivery and newsletter management; form processing; analytics; accounting, insurance, legal, and professional services; event production; ticketing; livestreaming; photography and videography; audiovisual production; and technical support. Service providers may use information only as reasonably necessary to provide their services, fulfill legal obligations, or as otherwise permitted by applicable law.
Events, rentals, and partnerships. We may share relevant information with performers, event organizers, rental clients, production personnel, caterers, security personnel, community partners, and vendors when reasonably necessary to plan, administer, or safely conduct an event or program.
Legal and safety purposes. We may disclose information when we reasonably believe disclosure is necessary to comply with a subpoena, court order, legal process, or government request; investigate suspected fraud, theft, harassment, threats, or unlawful conduct; protect the safety, rights, property, or security of Wally’s or another person; respond to an emergency; enforce an agreement or venue policy; or establish, exercise, or defend a legal claim.
Business or organizational transactions. If Wally’s undergoes a merger, restructuring, financing, transfer of operations, sale of assets, or similar transaction, information may be disclosed to professional advisers and potential or actual transaction parties, subject to appropriate confidentiality protections.
With your direction or consent. We may disclose information when you direct us to do so or provide consent.
7. No Sale of Personal Information
Wally’s does not sell personal information for money. Based on our current practices, Wally’s does not share personal information with unrelated third parties for cross-context behavioral advertising or use personal information to create advertising profiles across unrelated websites. If these practices change, we will update this Privacy Policy and provide any legally required notice and choice before beginning the new processing.
8. Data Retention
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, including to respond to an inquiry; administer a rental or event; process and document a donation; maintain a business, performer, vendor, or community relationship; maintain tax, accounting, insurance, and transaction records; document contracts, releases, and permissions; protect safety and security; maintain appropriate cultural and historical archives; resolve disputes; enforce agreements; and comply with legal obligations.
Retention periods vary based on the type of information and applicable operational, historical, contractual, accounting, insurance, and legal requirements. Security-camera footage is generally retained for a limited period unless it is needed to investigate an incident, preserve evidence, respond to an insurance matter or legal request, or protect the rights, safety, or property of Wally’s or another person. When information is no longer reasonably necessary, we may delete it, securely destroy it, de-identify it, or retain it in an aggregated form that does not reasonably identify an individual.
9. Information Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. These measures may include access restrictions, password protections, website-security tools, secure third-party payment processing, data backup procedures, service-provider oversight, staff procedures, and physical security measures.
No website, email transmission, payment system, or data-storage system can be guaranteed to be completely secure. We therefore cannot guarantee absolute security. If we discover a security incident involving personal information, we will investigate and provide notifications to affected individuals and government authorities when required by applicable law.

Depending on where you live, the information involved, and the laws applicable to Wally’s, you may have the right to:

Wally’s does not currently sell personal information or use it for cross-context behavioral advertising.

Please describe your request and identify the relevant interaction, such as a newsletter subscription, donation, venue rental inquiry, program registration, artist or vendor communication, or event-related matter.
We may need to verify your identity before completing a request. We will request only information reasonably necessary for verification. An authorized agent may submit a request where permitted by law. We may require proof that the agent is authorized to act for the individual and may separately verify the individual’s identity. Certain information may be exempt from a request, including information that we must retain for legal, security, tax, accounting, insurance, archival, contractual, or dispute-resolution purposes.
11. Children’s Privacy
Our general website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online directly from a child under 13 without legally required parental or guardian authorization. If we learn that a child under 13 submitted personal information online without appropriate authorization, we will take reasonable steps to delete it.
Wally’s may participate in youth music, educational, and community programs. Information associated with those programs may be collected through a parent, guardian, school, community partner, or separate registration and consent process. Parents or guardians who believe a child has submitted information without appropriate authorization should contact [email protected].
12. Sensitive Personal Information
Do not submit the following through a general website form or ordinary email unless Wally’s has specifically requested the information and provided an appropriate method for submitting it: Social Security numbers; complete banking information; complete payment-card information; government identification numbers; account passwords; detailed medical or health records; or other highly sensitive personal information.
13. Third-Party Websites and Embedded Content
Our website may contain links to or embedded content from third parties, including PayPal; social-media platforms; video platforms; music platforms; mapping services; event or ticketing services; merchandise providers; donation platforms; and community and business partners. These third parties may collect information when you interact with their links, content, buttons, players, forms, or services.
The third party’s privacy policy and terms govern its collection and use of information. Wally’s is not responsible for the privacy, security, content, or practices of independently operated third-party websites or services.
14. International Visitors
Wally’s is located in Massachusetts and operates primarily in the United States. If you access our website from another country, your information may be transferred to, processed in, and stored in the United States, where privacy laws may differ from those in your location. International visitors may contact us regarding rights available under the laws of their jurisdiction. We will honor those rights to the extent they apply to Wally’s activities.

We may update this Privacy Policy to reflect changes in our services, website, technology, legal obligations, or information practices. The “Last Updated” date at the beginning of the policy indicates when it was most recently revised. Material changes will be posted on this page.
